Please read this agreement carefully. By installing, accessing, or using the Software, you agree to be bound by it. If you do not agree, do not install or use the Software.
"Software" means the HWSolved browser extension, the HWSolved Pro desktop application, our website at hwsolved.net, our APIs, and any related services, updates, and documentation we provide.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the Software for your own personal use, subject to this agreement. The Software is licensed, not sold. We keep all rights not expressly granted.
You agree not to:
Each licence key is for one user. To enforce this, the Software sends a device identifier (a fingerprint derived from your browser or computer characteristics such as screen size, time zone, and platform) to our servers when you activate or use a key, and a key may be bound to the device it was first used on. Moving a key between devices more than the limits we apply may cause the key to be locked. If you changed computers or reinstalled, contact support.
The Software uses artificial intelligence to generate answers, text, or other output. AI output can be wrong, incomplete, or out of date. You are responsible for reviewing it before you rely on it. We do not guarantee the accuracy, completeness, or suitability of any output, and we are not responsible for any grades, decisions, penalties, or consequences resulting from your use of it.
Paid plans are offered as weekly, monthly, or semester (120-day) access, and some purchases are recurring subscriptions that renew automatically at the then-current price until you cancel. You can cancel a subscription at any time through the billing portal link in your receipt or renewal email, or by contacting support; cancellation stops future renewals and your access continues until the end of the period you already paid for. Payments are processed by our payment providers (Stripe, and for some legacy customers Whop); we do not store your card number.
Refunds are governed by our Refund Policy at https://hwsolved.net/refund-policy: if your licence key does not work within 12 hours of purchase, contact us and we will fix it or refund you; once a key has been activated and used, it is non-refundable. Physical hardware products (such as the Lockdown hardware bundle) are subject to the terms shown on their product page and at checkout.
Our collection and use of personal information is described in our Privacy Policy at https://hwsolved.net/privacy-policy. By using the Software you acknowledge that policy.
The Software and all related rights, including code, design, text, and trademarks, are owned by us or our licensors. Nothing in this agreement transfers ownership to you. We respect copyright and respond to valid notices under the Digital Millennium Copyright Act. See our DMCA Policy at https://hwsolved.net/dmca.
If you send us suggestions or feedback, you give us a perpetual, royalty-free right to use it without owing you anything.
We may update, change, or discontinue the Software or any feature at any time. We may change this agreement by posting a new version at https://hwsolved.net/eula; continuing to use the Software after a change means you accept it.
You may stop using the Software at any time by uninstalling it. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated this agreement or the law, or to protect the Software or other users. Sections that by their nature should survive termination will survive (including 3, 4, 5, 6, 9, 13, 14, 15, and 16).
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH ANY THIRD-PARTY WEBSITE OR SERVICE, OR THAT IT WILL CONTINUE TO WORK IF THOSE THIRD PARTIES CHANGE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SOFTWARE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SOFTWARE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $50, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.
You agree to defend and indemnify us against claims, losses, and expenses (including reasonable legal fees) arising from your use of the Software, your content, or your violation of this agreement, the law, or a third party's rights or rules.
This agreement is governed by the laws of the State of New Mexico, without regard to conflict-of-law rules. Disputes are resolved as set out in our Terms of Service at https://hwsolved.net/terms-of-service (binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules).
This is the entire agreement between you and us about the Software. If any part is unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver. You may not assign this agreement without our consent; we may assign it freely.
